Terms of Service

1. Acceptance of Terms

By accessing or using AIOneDesk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and API consumers.

2. Description of Service

AIOneDesk is a no-code platform for building, configuring, and deploying AI-powered voice agents. The Service enables users to create AI assistants that handle phone calls using third-party AI, speech, and telephony providers configured by the user.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials, including API keys stored in the platform. You must notify us immediately of any unauthorized access.

4. BYOK (Bring Your Own Key)

The Service requires you to provide your own API keys for third-party providers (e.g., OpenAI, Anthropic, Twilio, ElevenLabs). You are solely responsible for your relationship with these providers, including compliance with their terms of service and usage policies. AIOneDesk is not liable for charges incurred through your provider accounts.

5. Acceptable Use

You agree not to use the Service to:

  • Make fraudulent, deceptive, or illegal phone calls
  • Impersonate individuals or organizations without authorization
  • Violate TCPA, GDPR, or other applicable telecommunications and privacy regulations
  • Harass, threaten, or harm any person
  • Transmit malware or engage in phishing through voice calls
  • Make robocalls without proper consent
  • Violate the terms of service of any integrated provider

6. Billing and Payment

Paid plans are billed monthly or annually per seat. Usage-based charges (AI voice minutes, telephony) are billed at the end of each billing cycle. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.

7. Call Recording Compliance

You are responsible for complying with all applicable laws regarding call recording, including obtaining consent where required. Many jurisdictions require one-party or all-party consent for recording. AIOneDesk provides tools to configure recording disclosure messages, but compliance is your responsibility.

8. Data Ownership

You retain ownership of all data you create, upload, or generate through the Service, including call recordings, transcripts, and analytics. AIOneDesk has a limited license to process this data solely for the purpose of providing the Service.

9. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by AIOneDesk and protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to use the Service according to these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, AIOneDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the fees you paid in the 12 months preceding the claim.

11. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. Enterprise customers may negotiate custom SLAs.

12. Termination

Either party may terminate the agreement at any time. Upon termination, your right to use the Service ends immediately. We will retain your data for 30 days to allow export, after which it will be permanently deleted. We may terminate your account immediately for violations of these Terms.

13. Modifications

We may modify these Terms at any time by posting updated Terms on our website. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
